Terms of Service

    Short version: Use Falkon Billing for legitimate business purposes. Don't abuse the service, attempt to reverse-engineer it, or use it for unlawful activity. All plans include a 15-day free trial. Paid plans are billed monthly or annually. You can cancel at any time.
  

1. Acceptance of Terms

By downloading, installing, or using the Falkon Billing application ("App", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and NAQIX Technologies ("Falkon", "we", "us"), a company operating under UAE law.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into contracts in your jurisdiction. If you use the App on behalf of a business, you represent that you have the authority to bind that business to these Terms.

3. Account Registration

To access certain features you must create an account. You are responsible for:

Providing accurate and complete registration information.
Maintaining the confidentiality of your password.
All activities that occur under your account.
Notifying us immediately of any unauthorized use at support@falkonerp.com.

We reserve the right to suspend or terminate accounts that violate these Terms or involve fraudulent activity.

4. Subscription Plans and Billing

Falkon Billing offers the following plans. All plans include a 15-day free trial — no credit card required to start.

Starter: AED 9.99/month (or AED 6.99/month billed annually). Includes 100 invoices/month, unlimited customers, cash & bank payments, PDF sharing, multi-currency, and offline storage.
Silver: AED 29/month (or AED 20/month billed annually). Includes all Starter features plus card payments, customer credit tracking, and priority support.
Gold: AED 59/month (or AED 41/month billed annually). Includes all Silver features plus multi-user access, advanced reports, API access, and white-label invoices.

Prices are in UAE Dirhams (AED) and exclude any applicable VAT. Subscriptions auto-renew unless cancelled before the renewal date.

No refunds: Subscription fees are non-refundable except as required by applicable UAE consumer protection law. If you cancel mid-period, your access continues until the end of the paid period.

5. Payment Processing

Card payments collected from your customers through the App are processed by our secure payment partner. You are responsible for ensuring your use of card payment collection complies with all applicable laws in your jurisdiction, including VAT/GST collection obligations.

Falkon acts as a technology intermediary only. We are not responsible for chargebacks, disputes, or payment failures between you and your customers.

6. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation in the UAE or any other jurisdiction.
Process payments for illegal goods or services.
Commit fraud, money laundering, or any financial crime.
Reverse-engineer, decompile, or disassemble the App.
Attempt to gain unauthorised access to our systems or other users' accounts.
Transmit malware, viruses, or any other malicious code.
Harvest or scrape data from the App.
Interfere with or disrupt the integrity or performance of the Service.

7. Intellectual Property

The Falkon Billing app, logo, design, and all associated content are owned by NAQIX Technologies and protected by UAE and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for your own business purposes. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.

Your business data (invoices, customers, products) remains yours. You grant us a limited licence to process and store your data to operate the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

9. Availability and Updates

We strive to maintain 99.5% uptime for cloud services. However, we do not guarantee uninterrupted access. We may update, modify, or discontinue features with reasonable notice. The App's core offline functionality is not dependent on server availability.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be error-free, virus-free, or fit for any particular purpose. Tax calculations provided by the App are estimates only — you are responsible for verifying compliance with applicable tax law.

11. Limitation of Liability

To the maximum extent permitted by UAE law, Falkon's total liability to you for any claim arising from these Terms or use of the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of business data or profits.

12. Indemnification

You agree to indemnify and hold harmless Falkon, its officers, employees, and partners from any claims, losses, or damages (including legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE. We encourage you to contact us first to resolve disputes amicably.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Termination

You may stop using the Service and delete your account at any time. We may terminate or suspend your access immediately if you violate these Terms. Upon termination, your right to use the Service ceases, and we may delete your data in accordance with our Privacy Policy.
